ACIP Submits Comments to USCIS on Revised Form I-129

U.S. Citizenship and Immigration Services

On July 30, 2010, ACIP submitted written comments to the U.S. Department of Homeland Security (DHS) U.S. Citizenship and Immigration Services (USCIS).These comments were in response to the revised Information Collection on Form I-129 published by USCIS. As ACIP stated in earlier comments, the proposed revisions described in the Notice significantly change existing policy for the adjudication of H-1B and L petitions, and would create significant new burdens on U.S. employers, while having little practical utility to USCIS. Additionally, in light of current litigation and the USCIS Policy Review project, revisions to the Form I-129 are premature and confuse issues currently in flux within USCIS. Thus, ACIP recommended that OMB withdraw the revisions to Form I-129. Please see ACIP’s comments attached to this post.
